Image Upload Legal Requirements

 

You must be able to agree to all provisions in our Contributor Agreement in order to sell media files on ezMediArt; please read it thoroughly and make sure you understand your rights and responsibilities.

Ownership

You must have the legal rights for distribution of your submissions. Found or public domain images or illustrations cannot be submitted under any circumstances. If you do not have complete rights to the submission, you may not submit it.

For submitted work that contains any copyrighted material including paintings, other copyrighted photos, copyrighted logos, or any other art/advertisements/sculptures/exhibits which are copyrighted, you must either submit releases from the copyright owners or you must note to the curator the images are editorial.

If you are interested in finding out more about copyright, or in registering your work with the US copyright office (this is not necessary, but it can afford you additional legal protections), you can take a look at their website: copyright.gov

Talent and Property Releases

All commercially-oriented content that contains recognizable people must be accompanied by a signed Model Release (available here Model Release for Adult and Model Release for Minor). Releases need to be signed by the model(s) as well as by a witness other than the cameraperson/uploader. 

Even if you are the model in the image, we require a model release, signed by you and a witness. 

Property Releases (available here) are required when copyrighted or trademarked material appear.

We will accept other release agreements as well, as long as the legal provisions are roughly the same. 
Scans of signed releases should be uploaded in JPG or PDF format.

Before uploading clips of public buildings or landmarks, do a bit of research to see if you can legally sell images of it. Please consult the listing below for currently known intellectual property infringement issues:

Video Upload Legal Requirements

 

You must be able to agree to all provisions in our Contributor Agreement in order to sell media files on our site, please read it thoroughly and make sure you understand your rights and responsibilities.

When you upload a clip to ezMediArt, you are offering it for licensing to ezMediArt’s end-users, who will be able to use your work according to the terms of our Royalty-Free License. 

You MUST be the copyright-owner of any footage you make available for licensing on ezMediArt. Generally, if you created the footage, you are the copyright owner and are free to upload and market your work. If you are unsure whether you are the legal copyright-holder of a clip, don’t upload it. 

If you are interested in finding out more about copyright, or in registering your work with the US copyright office (this is not necessary, but it can afford you additional legal protections), you can take a look at their website:

Audio Upload Legal Requirements 

 

Ownership 

When you upload a clip to ezMediArt, you are offering it for licensing to ezMediArt’s end-users, who will be able to use your work according to the terms of our Royalty-Free License. 

You MUST be the copyright-owner or authorized representative of the owner for any audio you make available for licensing on ezMediArt. Generally, if you created the file, you are the copyright owner and are free to upload and market your work. If you are unsure whether you are the legal copyright-holder of a clip, don’t upload it. 

Audio files must be wholly the work of the person submitting the file. 

In the case of third party sound effects or loops incorporated into a larger work, the seller must ensure that all elements of their composition are cleared for resale and for use in a commercial project. 

If you're using third party loops, make sure that you know your rights and whether or not you can incorporate their work into your stock files before you upload. 

For royalty-free loops available through audio manipulation programs, as long as the loops are overlaid with other content and there's a majority original content in the track, there should be no problem incorporating them into your files.

Please note: we do not accept any content which has been submitted to digital rights management services such as GoDigital. These services block distribution via online platforms like YouTube, and therefore conflict with our end-user License Agreement
